Sergio Alanis, Sr v. Jesus Maria Alvarez

April 11, 2013

SERGIO ALANIS, SR., APPELLANT
v.
JESUS MARIA ALVAREZ, AND ALVAREZ & ASSOCIATES, APPELLEES

From the 381st Judicial District Court, Starr County, Texas Trial Court No. DC-00-328 The Honorable Federico Hinojosa, Judge Presiding

The opinion of the court was delivered by: Rebeca C. Martinez, Justice

ORDER

The reporter's record was due on March 18, 2013. The court reporter responsible for preparing the reporter's record in this appeal has filed a notification of late record stating that the reporter's record was not timely filed because appellant has failed to request and designate the reporter's record, if any.

It is therefore ORDERED that appellant provide written proof to this court within ten (10) days from the date of this order that a written request has been made for preparation of the reporter's record pursuant to TEX. R. APP. P. 34.6(b)(1).

If appellant fails to respond to this order within the time provided, the court will only consider those issues or points raised in the appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(c).

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 11th day of April, 2013.
