ORDER ADOPTING THE MAGISTRATE JUDGE'S REPORT AND RECOMMENDATION

RON CLARK, District Judge.

Timothy Paul Martin, proceeding pro se, filed the above-styled civil rights lawsuit against William Seamore. The court previously referred this matter to the Honorable Keith F. Giblin, United States Magistrate Judge, for consideration pursuant to applicable orders of this court.

The defendant has filed a motion asking that this matter be dismissed for failure to state a claim upon which relief may be granted. The Magistrate Judge has submitted a Report and Recommendation of United States Magistrate Judge recommending the motion be granted.
